Information on how to enter and the prizes form part of these Terms and Conditions. Participation in this Competition is deemed acceptance of these Terms and Conditions.
The Competition is only open to Eligible Entrants. An Eligible Entrant is an individual who: (i) is a resident of Australia or New Zealand who is aged 14 years or over; (ii) has approval to enter from a parent/guardian, if they are between the ages of 14 and up to 18 years; (iii) is not an employee of any of the Promoters or any of their related corporations or any of their agencies associated with the Competition; and (iv) is not a spouse, defacto spouse, parent, child or sibling (whether full, half, step or by adoption) of such an employee. Eligible Entrants between the ages of 14 and up to 18 years old must have parental/guardian approval to enter and further, the parent/guardian of the Eligible Entrant must read and consent to these Terms and Conditions. Parents/guardians may be required by the Promoters to enter into a further agreement as evidence of consent to the Eligible Entrant entering this Competition.
For Australian residents, the applicable stated times and dates in these Terms and Conditions are times and dates in Sydney, Australia (which will either be in Australian Eastern Standard Time (AEST) or Australian Eastern Daylight Savings Time (AEDST), whichever is applicable in Sydney, Australia). For New Zealand residents, the applicable stated times and dates in these Terms and Conditions are times and dates in Auckland, New Zealand (which will either be in New Zealand Standard Time (NZST) or New Zealand Daylight Time (NZDT), as applicable). All stated times are based on the 24 hour clock. 00:01hrs is the start of a day and 24:00hrs is the end of a day.
For a chance to win an instant prize, individuals must purchase any participating specially marked promotional product (featuring a label that refers to this Competition) from a participating store in Australia or New Zealand (as applicable) between 12.01hrs AEDST (in Australia) or 2.01hrs NZDT (in New Zealand) on 01/03/2013 and close of business on 30/06/2013 (Instant Win Purchase Period).
The participating specially marked promotional products in Australia are as follows:
600ml Pepsi Max bottle;

To find out if they have won an instant win prize, individuals who purchase a participating specially marked product during the Instant Win Purchase Period, must then check under the cap (in the case of the promotional bottles) or on the reverse inside of promotional packs (in the case of the promotional packs). If the bottle lid or the reverse inside of the pack contains a winning code word, the Eligible Entrant will win the instant prize indicated by the code word.
To claim the instant win prize indicated by their winning code word, instant winners must visit www.pepsimax.com.au (Australian residents) or www.pepsimax.co.nz (New Zealand residents), follow the prompts to the promotional claim/redemption page, input the requested details including the winning code word and submit the fully completed redemption form so that it is received by 23:59hrs AEST on 30/06/2013 (for Australian residents) or 01.59hrs NZST on 01/07/2013 (for New Zealand residents). Claims for instant win prizes close at 23:59hrs AEST on 30/06/2013 (for Australian residents) and at 01.59hrs NZST on 01/07/2013 (for New Zealand residents). Multiple entries and claims permitted, subject to the following: (a) only one (1) entry into the Second Chance Prize Draw permitted per specified purchase requirement; (b) only one (1) entry into the Second Chance Prize Draw permitted per person per day; (c) only one (1) instant win prize claim is permitted per participating specially marked product bearing a winning code word purchased during the Instant Win Purchase Period; and (d) each entry and claim must be submitted separately and in accordance with entry/claim requirements.
The Promoters reserve the right, at any time, to verify the validity of entries, claims and Eligible Entrants (including an individual’s identity, age and place of residence) and to disqualify any individual who submits an entry or claim that is not in accordance with these Terms and Conditions or who tampers with the entry/claim process. Errors and omissions may be accepted at the Promoters’ discretion. Failure by the Promoters to enforce any of their rights at any stage does not constitute a waiver of those rights.
Incomplete, indecipherable or illegible entries and claims will be deemed invalid.
Instant winners must retain their original promotional bottle lid clearly showing the winning code (in the case of a promotional bottle) and/or the reverse inside section of the pack that contains and clearly shows the winning code (in the case of a promotional pack) as proof of purchase. Failure to produce the original winning bottle lid and/or reverse inside section of the pack for all entries and claims as and when requested may, in the absolute discretion of the Promoters, result in invalidation of ALL of an Eligible Entrant’s entries and claims and forfeiture of any right to a prize.
Each entrant who enters the Second Chance Prize Draw more than fifty (50) times must retain their original promotional specially marked bottle or pack (as applicable) and their original purchase receipt/s as proof of purchase for each entry they submit after their fiftieth (50th) entry. Failure to produce the proof of purchase for all relevant entries when requested may, in the absolute discretion of the Promoters, result in invalidation of ALL of an Eligible Entrant’s entries into the Second Chance Prize Draw and forfeiture of any right to a prize.
If there is a dispute as to the identity of an Eligible Entrant, the Promoters reserve the right, in their sole discretion, to determine the identity of the Eligible Entrant.
Competition commences on 01/03/2013. Purchases for instant win prizes close at close of business on 30/06/2013. All claims for instant win prizes must be received by 23.59hrs AEST on 30/06/2013 (for Australian residents) and 01.59hrs NZST on 01/07/2013 (for New Zealand residents). Purchases for entry into the Second Chance Prize Draw close at close of business on 13/09/2013. All entries for the Second Chance Prize Draw must be received by 23:59hrs AEST on 13/09/2013 (for Australian residents) and 01.59hrs NZST on 14/09/2013 (for New Zealand residents).
The Second Chance Prize Draw will take place at Digital Glue, Level 5, 36 Grosvenor St, Sydney NSW 2000 on 19/09/2013 at 11:00hrs AEST (13:00hrs NZST), subject to any directions from a regulatory authority. Any prizes in the Second Chance Prize Draw will be awarded in descending order of value.
Instant winners will be notified in writing via the notification message on their winning lid or winning pack and then confirmed via email once they complete the claim mechanic outlined above. Any Second Chance Prize Draw winners will be notified via telephone and email. All winners of prizes valued at $500 and over will be published in The Australian newspaper and in The New Zealand Herald on 26/09/2013.
The Promoters’ decision is final and no correspondence will be entered into.
Instant win prizes available to be won in this Competition are as follows:
2 x 2013 Ford Ranger 4x4 XLT Double Cab, Pick-up, 3.2L Diesel, Auto (in a paint colour determined by the Promoter). Total prize value of each vehicle is up to RRP AU$58,025 (in the case of an Australian winner) or up to RRP NZ$60,690 (in the case of a New Zealand winner), including GST, warrant of fitness, 12 months vehicle registration, 12 months compulsory third party insurance, stamp duty and dealer delivery charges (which may vary depending on the winner’s State/Territory and region of residence). Additional insurance, options, petrol and all other ancillary costs are the responsibility of each winner. The colour of each vehicle will be subject to availability and will be selected at the Promoters’ sole discretion. Each winner must collect their prize from their nearest authorised Ford dealership. If a winner is, through any legal incapacity or otherwise, unable to register the car in their own name, then that winner may assign the car to another person (who consents to such assignment) with legal capacity for the purpose of registration. The Promoters take no responsibility for any such arrangements between the winner and the assignee. The winner must provide the Promoters with certified copies of all required documentation as required by the Promoters before the car is awarded. It is a condition of accepting the prize that the winner (or the winner’s parent/legal guardian if the winner is under the age of 18) may be required to sign a legal release in a form to be determined by the Promoters in their discretion.
2 x $30,000 Cash (as cheque or EFT payment in accordance with each winner’s preference);
60 x $500 Mastercard gift card;
200 x $100 Mastercard gift card; and
5,000 x $20 Mastercard gift card.
All cash prizes and Mastercard gift cards will be awarded in the winner’s local currency.
Any ancillary costs associated with redeeming the Mastercard gift card are not included. Any unused balance of the Mastercard gift card will not be awarded as cash. Redemption of the Mastercard gift card is subject to any terms and conditions of the issuer including those specified on the Mastercard gift card. Mastercard gift cards may be redeemed at all locations where the Mastercard gift card is accepted.
If a winner of any prize is under the age of 18 years, the prize will be awarded to the winners nominated parent or guardian on the winner’s behalf.
If for any reason a winner does not take/redeem a prize (or an element of a prize) by the time stipulated by the Promoters, then the prize (or that element of the prize) will be forfeited.
If any prize (or part of any prize) is unavailable, the Promoters, in their discretion, reserve the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
As at 01/11/2012 the maximum total potential prize pool value for Australian residents is up to AU$327,550. As at 01/11/2012 the maximum total potential prize pool value for New Zealand residents is up to NZ$332,880.
Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.
A draw for any unclaimed prizes from the Second Chance Prize Draw will take place on 20/12/2013 at the same time and place as the Second Chance Prize Draw, subject to any directions from a regulatory authority. Winners will be notified in writing and the names of any winners of prizes valued at over $500 will be published in The Australian newspaper on 24/12/2013.
Entrants and winners consent to the Promoters (and Ford Motor Company of Australia Limited (ABN 30 004 116 223) and Ford Motor Company of New Zealand Limited, collectively Ford) using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media at any time, for an unlimited period, without remuneration for the purpose of promoting this Competition (including any outcome), and promoting the Promoters and Ford, and/or any products manufactured, distributed and/or supplied by the Promoters and Ford.
If this Competition is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoters, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoters reserve the right, in their sole discretion, to the fullest extent permitted by law (a) to disqualify any Eligible Entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the Competition, as appropriate.
Any cost associated with accessing the promotional website is the Eligible Entrant’s responsibility and is dependent on the Internet service provider used.
The use of any automated entry/claim software or any other mechanical or electronic means that allows an Eligible Entrant to automatically enter/claim repeatedly is prohibited and will render all entries/claims submitted by that Eligible Entrant invalid.
Printing and other quality control errors will not invalidate an otherwise valid prize claim. Unless otherwise due to fraud or ineligibility under these Terms and Conditions, all prize claims in excess of the advertised prize pool will be honoured. Any unclaimed or un-won instant win prizes valued at over $100 that are part of the advertised total prize pool will be awarded in the Second Chance Prize Draw.
If due to any reason whatsoever the Promoter becomes aware after an individual has won a prize that the individual has not complied with these Terms and Conditions, such individual will have no entitlement to the prize, even if the Promoter has announced them as a winner and that entrant will be required, at the direction of the Promoter, to return, refund or otherwise make restitution of the prize.
Promotional specially marked products (including the winning bottle lids and reverse inside of the packs) will be void if stolen, forged, damaged, mutilated or tampered with in any way.
There will be a total of twenty five million (25,000,000) promotional specially marked products printed for this Competition.
Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act in Australia, or the Consumer Guarantees Act in New Zealand, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia or in New Zealand (Non-Excludable Guarantees). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoters and their associated companies (being Schweppes Australia Pty Ltd (ABN 51 004 243 994) & Frucor Beverages Ltd (including their respective officers, employees and agents) exclude all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Competition.
Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoters and their associated companies (being Schweppes Australia Pty Ltd (ABN 51 004 243 994]) & Frucor Beverages Ltd (including their respective officers, employees and agents) are not responsible for and exclude all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoters’ control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoters) due to any reason beyond the reasonable control of the Promoters; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or Eligible Entrant; or (f) use/taking of any prize.
As a condition of accepting a prize, each winner must sign any legal documentation as and in the form required by the Promoters and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.
Winners consent to the Promoters using their name, likeness, image and/or voice (including any photograph, film and/or recording of them) in any media at any time or times, without remuneration, for the purpose of promoting this Competition, the Promoters and/or any of the Promoters’ products.
Eligible Entrants personal information will be collected by or on behalf of the Promoters to enable them to administer the Competition and publicise the winner(s) and, if an Eligible Entrant consents, may be used to market the Promoters’ products to the Eligible Entrant. Entrants’ personal information will be held at Digital Glue, Level 5, 36 Grosvenor St, Sydney NSW 2000 on behalf of the Promoters for the duration of the Competition and at the addresses stated in condition 40 after the conclusion of the Competition. The personal information of the Eligible Entrants may be provided to others assisting in the conduct of the Competition, including the Competition administrator, prize suppliers and deliverers, and to regulatory authorities. Eligible Entrants may contact the Promoters by post at the addresses stated in condition 40 or by calling 1800 116 939 (for Australian residents) or 0800 502 929 (for New Zealand residents) during business hours or by visiting the Competition website to opt-out, request access to, or corrections of, any of their collected personal information that is held by the Promoters. If an Eligible Entrant does not provide accurate personal information the Promoters may, in their absolute discretion, determine that they are not eligible to win a prize.
The laws of Australia apply to this Competition to the exclusion of any other law for Australian residents. The laws of New Zealand apply to this Competition to the exclusion of any other law for New Zealand residents. Entrants submit to the exclusive jurisdiction of their applicable local courts.
